TERMS AND CONDITIONS

 

This contract is between The Farm (Bath) Limited (referred to as “TF”) and the relevant individual making the booking on behalf of their Group (referred to as “you” or “your”). You shall ensure that all members of your Group comply with these Terms & Conditions. All bookings made are subject to these Terms & Conditions. Your booking will be confirmed once the deposit or any payment required under these Terms & Conditions has been received by TF in cleared funds. Any booking constitutes acceptance of our Terms & Conditions. You must be 18 years of age or over at the time of making this booking.

1. Payment

Payment of the full balance of the total cost of your stay is due 42 days before the date on which it is to commence. For bookings made less than 42 days before arrival, the full booking amount will be requested immediately to secure the booking. If payment fails to reach TF in accordance with these Terms & Conditions, TF will notify you and you will have seven days to complete the payment. If full payment is not received within seven days of the date of notification, TF reserves the right to cancel the booking and in order to pay for administrative costs and to compensate TF, retain all deposits paid. All accommodation booked by you in these circumstances will immediately be publicly advertised as being available for re-hire.

2. Pre-authorisation charge - Security Deposit

We reserve the right to levy a pre-authorisation charge of up to £100 per tent on credit/debit cards. This pre-authorisation charge is in addition to the deposit. The pre-authorisation charge is required for the reimbursement to TF of any unusual costs which it may incur as a result of your stay, including without limitation: damage, breakages, exceptional cleaning costs, waste recycling sorting or delayed departure by you and housekeeper’s time reallocating items moved between tents. Guests should inform TF at the commencement of hire of any damage found on arrival. TF reserves the right to charge for any damage or missing items not reported by you on arrival. Should there be no reason for TF to retain the pre-authorised amount this will be released to you in full within 5 days of departure.

3. Cancellation By You

It may be necessary to cancel your stay due to illness, accident or change of circumstances. TF strongly advises visitors to take out full holiday insurance to cover cancellations, public liability and loss. As soon as you know that you need to cancel, please email us on stay@thefarmcamp.co.uk. Cancellation charges are calculated from the date we receive your booking, in accordance with table below:

Days before you start your stay: Cancellation charge

43 days or more: Deposit

42 – 36 days - 50%

35 – 29 days - 75%

28 days or fewer - 100% 

Deposit: 30% of the total booking fee.

Deposit payments are non-refundable and non-transferable in all circumstances. You agree that if you have not arrived by 8am on the morning after your stay was due to commence, or contacted TF to confirm your arrival, your stay with us will be deemed to be cancelled and the total cost will be forfeited to TF.

4. Cancellation By Us

In the event of TF having to cancel a booking for any reason whatsoever, its liability will be limited to all monies paid by you to TF in respect of that booking up to and including the date of cancellation. These monies shall be returned to you, as soon as possible, upon any such cancellation occurring. For clarity, in no event shall TF be liable for any special, indirect or consequential, costs, damages, charges or expenses incurred or suffered by you as a result of any such cancellation or for any of the following losses whether incurred directly or indirectly: pure economic loss, loss of business, goodwill, reputation or profits.

5. Termination of Stay

You are expected to maintain reasonable and appropriate standards of behaviour at all times whilst at The Farm Camp. TF have the right, at their sole discretion, to terminate your stay if you or members of your group are reasonably believed to be causing a nuisance to the other guests or are not treating the property with due respect. TF may require all or any such persons to leave the accommodation, without refund and in such an event, TF will not be liable for making any payment to you and in order to compensate TF for the nuisance caused will retain all monies paid by you.

6. Refusal of Entry

TF reserves the right to refuse entry to any or all guests within the party if these Terms & Conditions are not observed. Any function, celebration, party, corporate event or ceremony must have the written permission of TF. Any occupancy is for the purpose of a temporary holiday rental only and does not create the relationship of landlord and tenant between you and TF.

7. Care of the Property

During your stay you will take good care of your accommodation provided to you by TF. On your departure, you agree to (a) leave your accommodation in the same condition of cleanliness and tidiness as at the commencement of your hire; (b) to pay for any loss or damage caused by you, during your occupation. Any items moved from other tents must be returned to the appropriate tent prior to departure. Tents must be secured (zipped up, fires extinguished, all lights and water turned off) upon departure. TF reserves the right to charge you for any loss, damage or extra cleaning to our property during or after your stay. All decorations, must be removed and confetti must be biodegradable and used only outside. Waste recycling should be disposed in the correct bins.

8. Number of Persons using the Tents

There must be no more members in your group than the property is designed to accommodate which you will be advised on at the beginning of your stay.

9. Limitation of Liability

TF accepts responsibility for those arrangements that are within its control but cannot accept liability for any injury, illness, loss or damage suffered by you or any member of your party unless one of the following applies:

• There was fraud or wilful default by us or our employees, or

• Death or personal injury was caused by the negligence of TF or our employees.

Please notify any shortcomings, complaints or dangerous items and potential hazards to us immediately so that they can be remedied. Claims may be reduced or rejected if we have not been given the opportunity to put matters right or investigate them.

10. Arrival and departure times

The hire period commences at 4pm on the first day of hire and terminates at 10am on the last day of hire. Any significant delay in arrival should be notified to TF in order that arrangements can be made for entry into accommodation. Any significant delay in departure may incur a charge. Sunday departures may be extended until 7pm in the evening with the agreement of TF.

11. No Smoking Policy

Smoking is not allowed inside any tent and TF reserves the right to charge for costs of cleaning and redecoration if this provision is breached. Smoking is however allowed in the outside areas.

12. Pets

No pets are allowed at The Farm Camp unless agreed by the owners and farmers, locally.

13. Right of Entry

For the undertaking of necessary repairs, maintenance and/or inspections, TF has the right of entry to the property at all reasonable times. Prior notice will be given to you wherever possible and privacy will be respected at all times. TF or their appointed representatives reserves the right to carry out viewings at the property during the guest’s stay. At least 6 hours notice will be given to the guest wherever possible and disturbance will be kept to a minimum.

14. Indoor Swimming Pool and Associated Facilities

You should take all reasonable care and obey the pool rules displayed at the poolside. You are responsible for your own safety and the safety of your children whilst using the pool as it is unsupervised. No lifeguard is in attendance. Children under the age of 16 years and those people of any age who cannot swim must be supervised. Only paying guests of TF are allowed to use the swimming pool unless prior permission is given by TF. This is shared facility with the farm cottages and you will need to respect their use also.

15. Complaints

TF want you to have an enjoyable stay. In the event of any problem arising on arrival or during your holiday, you should immediately bring this to the attention of TF or its representative and TF shall, at all times, endeavour to deal with any complaint or query promptly. TF regrets that claims for compensation cannot be considered after the holiday has ended if there was no such prior notification.

16. Lost Property

TF or its representatives will retain lost property items at their office premises for 28 days from the date of your departure. For items to be returned, TF reserves the right to charge a flat administration fee of £10.00 plus postage and packaging, payment for which is required in advance. TF does not accept responsibility for returning any items and will not return any food or drink left at The Farm Camp.

17. Delay or Failure to Perform

TF will not be liable to you if we are prevented or delayed in performing any of our obligations to you if this is due to any cause beyond TF’s reasonable control including (without limitation): an act of God, explosion, severe weather, flood, fire or accident; malicious damage; outbreak of disease; any form of government intervention or a third party act or omission.

18. Changing these Terms & Conditions

TF reserves the right to revise and amend these Terms & Conditions from time to time. You will be subject to the most recent Terms & Conditions in force at the time that you make your booking, unless any change is required to be made by law or if we notify you of the change to these Terms & Conditions before we confirm that your booking has been successful.

19. Data Protection

TF will only store and use the information you supply to us for the purposes of carrying out our contract with you, to collect valuable feedback about how satisfied you were with the services provided and from time to time to send information regarding special offers and promotions at The Farm Camp. 20. Third Party Rights

These Terms & Conditions are made for the benefit of you and TF and is not intended to benefit any third party or be enforceable by any third party. The rights of you and TF to terminate, rescind, or agree any amendment, waiver, variation or settlement under or relating to these Terms & Conditions are not subject to the consent of any third party.

21. Governing Law

These Terms & Conditions are governed by the law of England and Wales, and any dispute arising out of or in connection with these Terms & Conditions is subject to the exclusive jurisdiction of the courts of England and Wales.

22. Catering provided by Third Parties (i.e. Hartley Farm)

All food delivered by Hartley Farm will be kept cool in a cool box throughout your stay.  The hire of the cool box is included in the price of the package.  If you would rather use your own means of refrigeration, please feel free to do so.

The temperature of the food will be taken on delivery. Once delivered it is your responsibility to ensure the necessary precautions are taken to keep your food items cold. If you believe there is a problem with the items on delivery, notify Hartley Farm immediately.

If you choose to use the cool boxes provided, please be sure to: 

Keep the lid firmly closed when not in use. 

-Store them in the facility provided by Farm Camp to keep them out of direct sunlight. 

-Do not remove the ice packs provided.

If you fail to follow this advice and you believe the quality/temperature of the food has been compromised, do not consume.

  

GROUP TERMS & CONDITIONS

Please note that the following Group Terms & Conditions are to be upheld in addition to the above Terms & Conditions. The relevant individual who makes the booking is responsible for ensuring that all of their party is aware of the Terms & Conditions and that they are adhered to.

‘Groups’ means parties who exclusively book out all of TF’s tented accommodation at any one given time.

1. Group Payments: As a group booking, all monies are to be paid in advance in a single payment. All payments are non-refundable and non-transferable in all circumstances.

The pre-authorisation charge is required for the reimbursement to TF of any unusual costs which it may incur as a result of your stay, including without limitation: damage, breakages, exceptional cleaning costs, waste recycling sorting or delayed departure by you and housekeeper’s time reallocating items moved between tents. Guests should inform TF at the commencement of hire of any damage found on arrival. TF reserves the right to charge for any damage or missing items not reported by you on arrival. Should there be no reason for TF to retain the pre-authorised amount this will be released to you in full within 5 days of departure. This is chargeable before you arrival.

3 Registration: All group members will need to be registered on arrival with a list of names and contact details.

4. Group size: A minimum of 12 guests are requested to book the Cotton Breeches site exclusively and 14 for Fry's Wood. They have a capacity of 16 and 20 respectively. In Fry's Wood, if you are a smaller group and would like your own beds, let us know and we can provide extra space, with additional fees for setting up more space and beds.

5. Extra Guests: Only those guests originally booked are permitted to stay on site. Any extra guests will only be permitted on site at the site owner’s discretion. If extra guests are permitted to stay, then extra charges will be incurred. TF also needs to know about any day guests (ie. those not staying the night). They will also need to be registered.
